Özet

European Court of Human Rights evaluateselectoral issues within the scope of right tofree elections. The right to free electionsisenshrined in Article 3 of the AdditionalProtocol to the Convention. On Article 3of the Protocol the Court has repeatedlystated that States have a wide margin ofappreciation in this sphere. Therefore,confirmation of the margin of appreciationenjoyed by States is a constant factor incases involving the right to free elections.However the application of the marginof appreciation in election cases is animportant problem. In the study, it will beassessed whether the States has the marginof appreciation in the administration andcontrol of the elections and electoralsystems.
