bölgesinde yer alan ülkemizin 11 ilinde
yaşanan deprem felaketi evlerin, araçların, işyerlerinin kullanılamaz hale
gelmesi ile sonuçlanmıştır. Maddi zararlara ilişkin tüm bu kayıpların haricinde
pek çok kişi neredeyse ailesinin tamamını göçük altında kaybetmiştir. Yaşanan
can ve mal kayıpları beraberinde pek çok hukuki meseleyi doğurmuştur. Yıkılan
binaların yapımını üstlenen yüklenicilerin, inşaata izin veren kişi ve
kurumların sorumluluklarının yanı sıra depremden kaynaklanan en önemli sorunlardan
birisi miras hukuku kapsamında gerçek hak sahiplerinin mirasçılık hallerinin
tespit edilmesidir. Zira miras hukuku ölenin malvarlığının (terekesinin) mirasçıları
tarafından yasal düzenlemeler kapsamında edinilmesini sağlamaktır. Gerçek
kişiliği sona erdiren doğal hal ölümdür. Ancak ölüm halini gözle görülür
şekilde her zaman tespit etmek mümkün olmayabilir; ceset bulanamayabilir. Bu
sebeple kanun koyucu ölüm dışında ölüm karinesi, gaiplik karinesi gibi halleri
ölüm olayının kabulünü sağlamak amacıyla kabul etmiştir. Karine olmaları sebebi
ile aksinin ispatı her türlü delille mümkün olan bu haller deprem sebebi ile
hayatını kaybeden ancak cesedi teşhis edilememiş yahut bulunamamış olan kişiler
bakımından önem arz eder.

Abstract
The earthquake disaster that occurred in 11 provinces of our country in the
earthquake zone on February 6, 2023 resulted in houses, vehicles and workplaces
becoming unusable. Apart from all these losses related to material damage, many
people lost almost their entire family under the landslide. The loss of life
and property caused many legal issues. In addition to the responsibilities of
the contractors who undertook the construction of the collapsed buildings and
the people and institutions that authorized the construction, one of the most
important problems arising from the earthquake is the determination of the
inheritance status of the real rights holders within the scope of inheritance
law. Because inheritance law aims to ensure that the deceased's assets (estate)
are acquired by his heirs within the scope of legal regulations. The natural
state that ends true personality is death. However, it may not always be
possible to detect death visibly; The body may not be found. For this reason,
the legislator has accepted situations other than death, such as the
presumption of death and the presumption of absence, in order to ensure the
acceptance of the event of death. These cases, which can be proven otherwise
with all kinds of evidence because they are presumptions, are important for
people who lost their lives due to the earthquake but whose bodies could not be
identified or found.
